These Terms of Service (“Terms”) govern your access to and use of IMAHub, the web application at imahub.co and the “Add to IMAHub” browser extension (together, the “Service”). IMAHub is a product of DM Sales Solutions Ltd, a private limited company registered in England & Wales (company no. 16304299), registered office 81 Park Grove, Hull, HU5 2UR (“IMAHub”, “we”, “us”). “You” means the account holder. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 and able to form a binding contract. The Service is intended for business use by influencer-marketing agencies, creators, and brands. If you use it on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms.
IMAHub helps you discover, score, and manage YouTube creators and brands through to a deal, including optional outreach tooling. The Service depends on third-party services and your own API keys (for example YouTube, Anthropic, and Instantly). It is a tool that surfaces and organises information; the decisions you make, the messages you send, and the deals you strike are yours.
You are responsible for the activity under your account and for keeping your credentials and API keys secure. Tell us promptly of any unauthorised use. We may suspend accounts that appear compromised or that breach these Terms.
The Service integrates with third parties including Google/YouTube, Anthropic, Instantly (including its SuperSearch add-on), and Stripe. You are responsible for your own accounts with those providers, for any fees or credits they charge, and for complying with their terms. We are not responsible for third-party outages, rate limits, pricing, quota exhaustion, or changes that affect the Service, and we do not guarantee the accuracy, completeness, or deliverability of any data returned by them (including contact details or email addresses surfaced by contact-finding features).
The Service can help you find business contact details and send outreach (for example via Instantly). You are solely responsible for how you use these features and for the messages you send. In particular, you agree that:
We act only as a tool/processor acting on your instructions for this activity. To the extent permitted by law, you are responsible for claims arising from your outreach or data use (see “Indemnity”).
You will not: break the law or infringe others' rights; scrape, resell, or redistribute the Service or its data other than as intended; reverse engineer or attempt to extract source code; circumvent plan limits or security; overload or disrupt the Service; upload malware; or share your account to give unauthorised parties access. You will also comply with the terms of the third-party providers the Service uses.
You keep ownership of the data you put into the Service (creators, brands, notes, rates, and so on). You grant us a limited licence to host and process it solely to provide and improve the Service for you, as described in the Privacy Policy. You are responsible for having the rights to the data you upload.
Some features use AI to generate drafts, classifications, or suggestions. AI output can be inaccurate or incomplete. You are responsible for reviewing anything before you rely on it or send it.
The Service, its software, and its branding are owned by IMAHub and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing; no other rights are granted.
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, that data (including metrics, CPM estimates, or contacts) will be accurate, or that using it will produce any particular business result, deal, or revenue. Nothing in these Terms limits liability that cannot be limited by law (for example for death or personal injury caused by negligence, or fraud).
To the fullest extent permitted by law, IMAHub will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service in any 12-month period will not exceed the greater of (a) the total fees you paid us for the Service in the 12 months before the claim, or (b) £100.
You will indemnify and hold IMAHub harmless from claims, losses, and costs (including reasonable legal fees) arising from your use of the Service, your content or data, your outreach, or your breach of these Terms or of any law or third-party terms.
You may stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to us. On termination, your right to use the Service ends; sections that by their nature should survive (e.g. payment owed, IP, disclaimers, liability, indemnity) will survive.
We may update the Service and these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example by email or in-app). Continuing to use the Service after changes take effect means you accept the updated Terms.
You may not assign or transfer these Terms without our prior written consent. We may assign, transfer, or novate these Terms and our rights and obligations under them — including to a successor or buyer in connection with a merger, acquisition, reorganisation, or sale of all or part of our business or assets (including the IMAHub product) — on notice to you, provided your rights under these Terms are not materially reduced.
These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, without affecting any mandatory consumer-protection rights you may have where you live.
